Legal framework governing the purchase and operation of USA MiniEx equipment.
Please read these terms carefully. By placing an order with USAMiniEx.com, you agree to be bound by the following conditions. This agreement is between the customer and USA MiniEx.
All orders are processed securely via PayPal. Customers may utilize major credit cards through the PayPal guest portal. Full payment is required before an order is processed for shipping or released for warehouse pickup. USA MiniEx reserves the right to cancel any order due to pricing errors or suspected fraudulent activity.
USA MiniEx provides free freight shipping with lift-gate service to the Lower 48 United States. The Risk of Loss passes to the customer upon delivery by the carrier. It is the customer's sole responsibility to inspect the machinery for transit damage prior to signing the carrier's delivery receipt.
Our equipment is backed by a 12-month warranty covering manufacturing defects on all parts. This warranty is strictly Parts-Only; labor costs associated with repairs are the responsibility of the customer.
CRITICAL CONDITION:
The warranty is valid only if the owner maintains a Monthly Maintenance Log (including engine hours, grease intervals, and fluid checks). Failure to provide this log upon a warranty claim may result in the denial of coverage. Wear items (tracks, teeth, hoses) are excluded.
Heavy machinery operation involves inherent risks. USA MiniEx and its owner, shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or misuse of our equipment. All machines are CE-certified; however, the operator is responsible for following all OSHA and local safety regulations. Use of this machinery is at the operator's own risk.
Returns are only accepted for unopened/unused items within 30 days of delivery, subject to a 20% restocking fee and customer-paid return freight. Once a machine has been fueled or operated, it cannot be returned. Cancellations made prior to shipping are subject to a 3% PayPal processing fee.
These terms and conditions are governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising from the purchase or use of USA MiniEx equipment shall be resolved in the courts of El Paso County, Colorado.
